    The thing is, Excel HAVE changed those signs (early July...?) which you would find mentioned in the other Peel Centre threads I keep suggesting you read (you will find better POPLA appeals than that one).

    And I must admit I don't favour that template POPLA appeal about 'life's twists & turns' which is very, very rambling and needs weeding out the rubbish (not your fault but the template appeal goes on too much)!

    And your paragraph about KFC Careline (LOL!) adds nothing to the appeal grounds at all, not even a receipt helps at POPLA.

  • I have read through the other Peel Centre posts and I am stuck for what else I could put. I'm constantly at work and wrote this up with a free hour I had. What would you suggest?

    This is moreorless a straight 'lift' from Delprimero's appeal, from pepipoo.

    Using others' appeals as a starting point is recommended, and copying specific paragraphs very useful, but it really should, overall, be in your own words and style. The more adjudicators see word for word templates the less likely they are going to take the trouble to read them as well as PPCs finding a form of words to overcome them.

    Concentrate on signage, pre-estimate of losses and contract with landowner. The gist will be covered in the appeal you've used but you do need your own words to at least give it the impression that it was you who wrote it.

    I never liked the opening bit about 'if you read this you agree to a contract payment .......' and it's rather tired now - and it's what identified it to me as being Delprimero's appeal from June.

    Things have moved on now and much sharper, focused appeals can be made and produce the positive outcome.

    I agree. On long winded appeals, if the adjudicator doesn't fall asleep first, they are likely to miss the key point in the mass of repetitious froth.

    Remember POPLA are drowning in a backlog of appeals and shorter sharp ones will be welcomed.

    But all of the appeals must have the key points of course.

    three things for you,,,,a)please amend cost to park to £1.30p,that was the fee when you parked there.,,b)i patrol there regurlarly informing unsuspecting motorists of the scum known as excell and their scam,the signs now and since late june/first week in july are 100% clear and visible,,prior to that they were pathetic and unreadable,hail michael cutts.so you cannot use that as an excuse anymore,,although they have since come back and added a sign to the sign,stating this is a 24 hour p&d as many motorists still believe its free after 6pm(it always was but scum excel did not bother to tell anyone it wasnt,even after the new signage was placed,since then as i say they have rectified),,c)what was bondy doing after the 4th goal last sunday,,answer,,still celebrating the 3rd,weyyy,,,,sorry couldnt resist,,,,,,good luck in spanking this lot,we are all on the same team in this case.

  • Hi Guys,

    thanks a lot for your help, especially Bondy, nice to know we are against Excel (even if you are on the Blue side) ha.

    I redrafted this appeal taking out the signage and the additional £1.30 cost.

    You'll be glad to know I got my appeal result today (4 weeks late) and the assessor accepted my appeal and i'm pleased to know Excel have to rip my ticket up. Feel like sending them a letter for harrassment lol. The assessor stated:

    The operator does respond to the appellant’s submission that the charge is not a genuine pre estimate of loss. However, their submissions do not sufficiently address such issue.
    Having considered all the evidence before me, I must find that on this particular occasion, the operator has insufficiently dealt with the issue of genuine pre estimate of loss raised by the appellant. As the appellant raised this point, the burden of proof has shifted to the operator to prove that they do. On balance of probabilities, I find that the operator has not discharged the burden.
    Accordingly, this appeal must be allowed. Aurela Qerimi
