Tenant deposit protection scheme

Just handed my notice in on my flat. On my tenancy it says my deposit has been held in a deposit protection scheme. When I enquire about my deposit my landlord says I never paid one? I contact the letting agent who I signed with and they seem to have no record but say I would have paid one. Luckily I have the paperwork to say I have paid!

It turns out in the end the landlord keeps all the deposits. The letting agents say that as they do not deal with landlords tenants once signed up (landlord does not continue to use them to manage property) it is down to the landlord to sort out deposit. So it seems to me someone has bent the rules here by not placing them in a deposit protection scheme as stated in the tenancy. I am furious.

Just goes to show do not trust what your tenancy says, letting agent or landlord!

    As long as you have proof of payment, you are fine.

    Check with each of the 5 deposit scheme (link below) to findout forsure if it was registered.

    Your landlord is legally responsible for the deposit. If he did not register it, you can sue him and claim 3 times the deposit as a penalty.

    Write to him (yes, a letter) and ask for confirmation he protected it in accordance with the Housing Act 2004 (even if you know he did not!).

    That will let him know he is in trouble. He will then be unlikely not to return it to you in full.
