No refund no exchange - just how legal??

Ordered cheap theatre tickets online as a surprise for my better half but when I found out she'd already seen the play I went online to cancel...

The site got back in touch (couldn't get through on the phone) after 2 days.
I'm still waiting to hear what the bank says (they still took my money despite me telling them I wished to cancel)
They got back to tell me that they have a no refund/no exchange policy on tickets and that since the performance had already occurred during the time it took for them to reply back they couldn't help me.

My question is the site have admitted that T&C are only visible once tickets are purchased.
However, the T&C are not visible anywhere on the ticket invoice I printed off. You have to hunt for them on the site.
Surely under the Consumer Rights act, any business saying they have a no refund/no exchange policy is breaking some law?


Can anyone else advise me on my next steps?

    Provided that the T&C's can be read before making the purchase, they don't have to be printed on the tickets.
    Presumably when you made the purchase, there would have been a tick box stating that you had read and agreed to their terms (most websites normally provide a link to the terms at this stage).

    As to the no refund/no exchange policy.
    This is totally legal as there is no statutory right to a refund for change of mind or tickets not being suitable as event tickets are one of the exceptions to the right of cancellation under the distance selling regulations.

    What was the name of the company that you purchased the tickets from?

  • Don't Distance Selling Regulations state that from the moment something is purchased, you have a certain time limit to change your mind?

    Event tickets are an exception as already mentioned.
  • (2) Regulations 7 to 19(1) shall not apply to
    (b)contracts for the provision of accommodation, transport, catering or leisure services, where the supplier undertakes, when the contract is concluded, to provide these services on a specific date or within a specific period.

    And the right of cancellation is covered by regulation 10, so tickets are exempt from this right.

  • Why would you automatically assume you can cancel for a refund or exchange? You have no right to either and to assume you do is very misguided.

    Next time talk to her instead of assuming you can cancel. You won't see your money again.
