Very.co.uk and the broken Tablet

Hi Peeps,

Looking for a bit of advise as I am at a loss of what to do next.

Last July I bought a Gemini Joytab last year for my Daughter to put away for Christmas. I tested it at the time and stupidly though it would be ok.

Christmas came and went and my daughter was happy but a week later it stopped charging. I wrote to Very frustrated but was told to give Gemini a call as it was passed the 30 days. I argued the case but they were having non of it so contacted Gemini who sent me to a website to arrange return. I filled in the details of the product but no email came back to advising me how to send the item for repair. I had to chase them up to a month before they gave me a prepaid label for me to send it.

Another month passed and I finally got the tablet back. Stupidly I forgot to remove my daughters Mini SD card out of the machine and when it came back it was gone. I email them to see if it could be sent back but never got a response.

As my daughter didn't have her SD card with her songs and films she neglected the tablet until June when she saved her pocket money up to get a new micro card but low and behold the tablet wouldn't load into android and again wont charge or switch on.

I contacted Very and was promised a call from the customer excellence team but they never called. Instead I got a clear letter templated response telling me to contact Gemini again. I tried to contact Gemini and again no response until my wife finally contacted them today and was told that as it was out of warranty we could send it for repair but it would cost us.

Now I know I am a stupid sausage for buying this product 6 months before Christmas but I am so frustrated and angry not just that my daughter has had less then a week of playtime with her christmas time but that fact both Very and Gemini both have the most shocking customer service. Particularly Very who are quick to call me to offer fantastic finance deals yet when you have a complain they dont want to know.

Is there anything I can do or any legal path I can follow? I have told them I will close my account down yet it doesn't seem to bother these people...

    You have NO contract with them
    Your contract is with Very.co.uk
    What they say about after 30 days is total rubbish.... it has no basis in law
    The goods you purchased need to be
    1. As descibed
    2. Of Merchantable qaulity
    3 Last a resonable time
    You say it will not charge ..... so it fails the tes's
    2. it clearly was NOT of merchantable quality ( otherwise it would
    be working )
    3. it fails the test to last a reasonble time
    7 - 9 months is NOT a reasonable lenght of time
    If you paid on a credit card
    contact the card company and say that they should do a charge back
    under section 75 of The Consumer Credit Act ....
    if not write a letter to Very a give them 14 days to refubd the full amount
    if they do not do this sue through the small claims court
    you will win hands down and the will have to pay the court fees
    its that simple Do not be freightened by Court Action its easy....

    Barryjohnwebb1947, this not good advice.

    For a start, the test for 'lasting a reasonable amount of time' is not 'it doesn't work after fourteen months'.
    It could not be working for a number of reasons... like it has been bounced down the stairs, run over by a car, etc, etc.
    Of course it could also be of faulty manufacture.

    The test is confirmation that the thing has a fault that was present at the time of sale but not necessarily apparent at that time... an inherent fault.

    It is for the consumer to prove that the fault is inherent.

    Without that proof, any court action will fail.

    I have replied but I don't hold much breath that you well help as I have already emailed this email address previously when I voiced my anger on facebook.

    No doubt I will get a standard response about telling my how sorry you are for the treatment but I need to go to Gemini.

    Again I do not know if I have a legal leg to stand on but I still know I was sold a product that was unfit for sale Mainly the two things I have learned are A) Not to buy a product 6 months before christmas and B) Never....EVER..... buy it from Very.co.uk!
