Binatone e-reader failed, nobody wants to accept responsibility

Just under a year ago, I purchased a Binatone ReadMe Colour e-reader. A couple of weeks ago, it went wrong, incorrectly reporting the amount of internal memory and failing to even recognise the presence of a Micro-SD card when it was inserted into the device. This has made the reader totally unusable for any purpose. So I contacted Binatone by e-mail to ask if this was a known fault and if there was a solution. They replied very quickly and said I should contact the company I purchased it from as it was still just under its 12-month warranty. So I did this, again via e-mail. They responded that I should call Binatone on an 0845 number they gave me, despite my pointing out that I had already been in contact with them. So I need to know before going any further who actually has the responsibility for sorting this out?

Payment method: Credit card
Fault type: Failed internal memory & memory card access
Vendor saying: Contact the manufacturer (who says contact the vendor!)

Your contract is with the retailer that sold it to you so they are responsible under the Sale of Goods Act for any inherent faults (i.e not caused by misuse, accident or fair wear and tear). It would be normal for them to send it back to the manufacturer for repair though.
Note that as it is more than 6 months since purchase the retailer may require you to prove it is inherently faulty.0 -
Well, I e-mailed the retailer to point out their legal responsibility under the Sale of Goods Act, and since then their silence has been thunderous - not a peep back.
Any suggestions for the next step if they continue their silence?0 -
