I've had a few years of visits from bailiffs, and now I'm getting to the end of the nightmare I was wondering if anybody has successfully claimed back bailiff fees? Also are there any templates out there, that I could us?

You are always better re-claiming from those that employed them as Principle is responsible for actions of an agent.
If it is a local council, a quick credit check reveals that most already have hundreds of CCJ's and could not care less, let alone try to pay them.Be happy...;)0 -
Under what circumstances or reasons do you think that you can reclaim these charges.
Where they there because you owed someone one some money and didn't pay ?make the most of it, we are only here for the weekend.

Hi,
Keeping an open mind about how my original post reads, I'm just looking at whether bailiff fees applied incorrectly have ever been reclaimed successfully. For instance where I have been charged for two visits for two debts, when only one visit was made.
Yes in the past I have had debts that I hadn't paid in time, but that is part of my life which is almost behind me.Known Debt at time of the Great Escape - £5,467.85

the visits were for various things including council tax and parking tickets.i would need to go through the whole subject access request process to get the information.
It's more of a case of would I be chasing a lost cause, or is this going to be the next campaign after bank charges?Known Debt at time of the Great Escape - £5,467.85

I only do council tax and if you have been overcharged (for want of a better word ) then yes you can claim them back from your council
I notice from your status you are in wales its not Wrexham by any chance
you don't need a subject access request send the template letter to both the council and bailiff firm (can be done by e-mail and/or recorded delivery letter)
to get the complete picture you need to get on to the council and ask (if you don't have the liability order ref no's the council should be able to give you them
1 - how many Liability Orders they have against you
2 - the dates they were obtained
3 - the addresses they were for(if you have moved home )
4 - the period of time each covers
5 - how much each one was for
6 - how much is still outstanding (if you still have an outstanding balance )
7 - the dates they were passed on for enforcement
8- the date and amount of each payment received from (bailiff firm)
Send this to the council and the bailiff firm (if more than one debt put all ref no)
From:
My Name
My Address
To:
Acme bailiff Co
bailiff House

Dear Sir
With reference to the above account, Can you please provide me with a breakdown of the charges.
This includes:
a - the time & date of any Bailiff action that incurred a Fee.
b - the reason for the fee.
c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.
d - the name(s) of the Court(s) the Bailiff(s) was/were certificated at.
e - the date of the Certification.
f- if a levy fee has been charged please provide a copy of the notice of seizure or a list of goods levied
This is not a subject access request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.
I require this information within 14 days.I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

Everybody has bank charges. In proportion there are considerably less getting visits from officers of the court, then less so for multiple visits! The reclaiming would have to be done from the entity who supplied the service.
What you are effectively seeking is a quantity discount but if the bailiff has three executions to make, why do you believe he should only be paid once for a single visit when multiple creditors are involved? There is no central clearing house for court administration, and the fee includes not just the visit but the administration of paperwork.
The debtor is not in any position to complain unless the work that was carried out was deficient in done way, if the only concern is that your hit my multiple fees the secret is not to let it get out of hand - not seek a rebate because you are such a 'good' customer.0 -
Beg to differ Buzby, Ive never paid a bank charge in me life.
I'm far too greedy to be paying somebody for nothing lol.
Perhaps Ive just been lucky that I have never needed to.make the most of it, we are only here for the weekend.
