Long time lurker, first time poster. The above company has got me so mad I just wanted to warn others.

In March I bought a product from them which I did not start using until June. It has had a fault which is getting progressively worse so finally I emailed them at the weekend. Their response was that as I bought the product more than 6 months ago I need to go to the manufacturer!

I have emailed them back with the following

Hi,

I am very surprised that you are trying to refer me to the manufacturer given that you are listed as a business seller.

As you may be aware, the Sale of Goods Act states that my contract is and remains with you the seller. The act also states that goods should be expected to last a reasonable amount of time. I would imagine that a pump costing over £100 should last more than 6 months (especially as I have only used it for three!)

I would be grateful if you can therefore look at my request again.

    What was your initial request?
  • As it was through Amazon, I sent the return request (the only option available) but said in the comments field that it was faulty.

    I know it is up to me to prove the fault is inherent as I got it more than 6 months ago so I half expected that to be their response.

    Why don't you contact the manufacturer? If they won't do anything you can pursue your rights through he seller but it may be a lot easier (and quicker) to just do what they suggest

    After 6 months the onus is also on you to prove the item was inherently faulty. This could include the seller asking you to pay for an independent report to prove this. The money will be reimbursed if the fault is inherent.
    Also, the seller can then choose to repair, replace or refund, the choice is theirs, not yours. You can specify a preference but they do not have to go with this.
    And then, they're likely to repair/replace by returning the product to the manufacturer for a repair or a replacement unit.


    So, you can go that way^ or you can just contact the manager yourself now and cut out the middle man.
