A question on ex council RTB home and deeds transference.

go back and read the quote and link in my post at #20After over 20 replies though i have still not got an answer (however irrelevant now) to my original enquiry as to whether I can add his name to the deeds without penalty before i kick it.
The RTB rules say you can only buy (solely or jointly) if the proposed purchasers have lived in the property 12 mth's prior to purchase but what about after the sale.
Is there some such rule that allows you to ADD a JOINT owner after they have resided in the property for a certain length of time ?
it is your council which will enforce the rules and agree to your proposal. You have already spoken to them and got their interpretation - which you do not accept.
Your best option now is to seek professional legal advice over what will happen after your death since any dispute will have to be on legal grounds not on the advice of random quality internet forum posts.0 -

sorry OP but I have to agree, your council are the ones who have the answer to your original question,
I really don't understand why you say you would have done things differently had you known of your illness,
you have bought your home , given yourself security, also have a family house to leave for your son when your time comes ,
you should be very proud of that and your son I am sure is very happy that you did,

Surely if one were to marry,the new wife could be put on the deeds.
Would they have to live in the property for a specific length of time or would they have to wait till the 5 years have passed.
The only people who could answer that specific question would be the council.

If I had found out sooner and had more time i would have moved him in for 12 months and bought the house jointly but that's irrelevant now as it's clear that just leaving it in the will is good enough and the transfer isn't counted as a sale in the event of a death.
All that will happen is that the RTB agreement is transferred to my son in my place so he will have to pay back a % of the sale if he sells within the remaining portion of the original 5 years.
if you had done as you suggest above, with yourself and your son buying jointly, under the HTB scheme he would still have to wait the required time before he could sell or pay the penalty,
I must have misunderstood you , I thought you wanted your son to have the house as his family home ,
whichever way you had bought the property the outcome would be the same.0
