life after IVA

In 2006 I entered into an IVA which was settled in April 2010 (1 year early). Now 3 years on I have finally had the courage to apply for credit only to be turned down flat! (My wife wanted a new sofa!). After my IVA finished I felt very much in the dark regarding help on building up my credit report and what would happen in the future. I have today accessed my crdit report for the first time only to find that my IVA is STILL on my report (which I was told that the year after my IVA finished it would be removed) no mention of me having to write to the credit =reference companies to have it removed. My biggest issue though is that when the IVA was completed in April 2010, one month later in May 2010 one of the creditors on the list who were out voted by majority and didn't send and representative to the final meeting added a default to my account (not impressed) can creditors do this even when the IVA has been completed and I have the certificate from the court and am I also within my rights to write to the creditor sending copies of the certificate and ask for this default to be removed?
Really hope someone is able to help me.............I have done everything that was asked during and after my IVA but feel really let down

I think the IVA stays on your account for 6 years, but I may be wrong. Accounts stay on 6 years from default date, so I doubt finishing the IVA early will remove these before the 6 year point.
As for the creditor defaulting you, they would have to default you for an IVA according to the ICO guidelines. The question is, is that default actually too late? Should be defaulted within 6 months of not paying/paying less than contracted payment, but depends on payment history of the account and if you agreed to an arrangement.

As above, all accounts on your credit report included in the IVA MUST be recorded as a default, and MUST have that default backdated to the start date of your IVA.
Hence this default should be backdated to 2006 and so dropped from your credit reports.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
