  • Have you seen a copy of the section 21 so you can check it was properly served?
    Have you checked the deposit is indeed registered?
    Have you checked whether a full inventory was done at the start of the tenancy?

    Whilst it is no doubt tempting to trust the letting agents, many tenants and some landlords have fallen victim of letting agents before. They may or may not have actually served notice and they may also have messed up the dates so do be aware.
    Easiest thing is probably just to say to them 'I appreciate you've served a S21. Is there any chance I could have a copy of it for my files?'. If they are as good as you say they are then they will surely have no problem in doing this.

  • If they are receiving commission on the rent and can see the end of their income-stream on the horizon I would not trust them to ensure the documentation is correctly served. It's in their interests to see the tenancy continuing, not ending

    you are homeless because you moved out of your rented accommodation before you needed to, unlike this man who is exercising his statutory rights to remain until you get a court order

    The person at fault here is your letting agent for not explaining the eviction process to you correctly.

    I don't see any problem with this, as long as they are paying their rent during the overstay (I accept that some don't, but that's another matter).

    It's just something that a savvy LL has to allow for when he lets a property

    Under what grounds is the court action proceeding?

    I recall reference to the T not paying their rent - do the arrears equate to more than 2 months' rent?

    If so, when did this situation arise? And are the LA using the s.8 non-payment of rent route as a parallel basis for eviction?
