It is more about Search Engine Optimisation. The s21 is the notice to quit. In order to actually make you leave the landlord needs to go to court to gain possession (and then bailiffs if you still refuse).
The costs of these are in the region of £200. The form asks if they want the tenant to be responsible for the cost, tick yes and then the tenant is responsible. Therefore you can effectively say goodbye to your deposit as they will likely have a court order which includes you owing them fees so dps would award it to them.
Have you discussed it with the letting agency? Explain you are looking to buy a house therefore do not wish to sign a new contract and would like to roll onto a spt automatically. This means they are still getting the monthly percentage from a reliable tenant who pays on time and is looking after the property and will be able to provide them with ample opportunity to relet when you move on. Surely this is better than have it empty for a period of time whilst reletting, after all with no guarantee (no obligation for us to do so) we would leave on the s21 date the letting agent would be irresponsible to relet based on that date therefore there is a guaranteed empty period whereas your solution means they don't have that.
Alternatively, if they take it to court you have a few months at least before it all kicks in.0 -

I think the agent is trying it on a bit and trying to pressure us into paying their fees, expecting that we won't have any understanding of the process and think we must either pay up or leave by the date on the notice. They've been a bit on the useless side but generally nice/reasonable enough so I will talk to them about our circumstances and hopefully be able to come to an agreement.
One more question from me though - is a Section 21 Notice valid if the copy served on the tenant hasn't been signed/dated?
The notice we received contains all the required information but on the second page there is a space for it to be signed and dated by the landlord/agent and this is blank. They've printed it out and just put it in the post. If the notice isn't valid without a signature I'll wait until after our next rent payment to talk to them so as not to bring it to their attention in time for them to serve a signed copy so we'll get another month's leeway.Common sense?...There's nothing common about sense!0 -
