PPI Claim with motor dealer?

Hi all
Been a while since I last posted, been waiting on the Ombudsman's decision on a PPI I was mis sold in 2002. After nearly a year the Ombudsman have came back to me saying they don't have durasticiton because the PPI was sold to me by the motor dealer and not Black Horse which is who I complained to previously.
Can I now send the complaint form off to the motor dealer or am I completely stuffed?
I'm actually pretty annoyed because I bought my first motorbike through a dealer and took out PPI when I signed the paperwork at the dealer. Finance and PPI was with Black Horse and I have had that PPI payed back already last year.
Second bike was bought in exactly the same way through a different dealer, finance/PPI through the dealer with Black Horse, but now they say it's nothing to do with them?? Safe to say that the one they're not paying out on is worth much more.

You are stuffed. Your complaint was always against the dealer but the dealer didnt become regulated until Jan 2005. So, you never had access to the FOS. Do you mean the first one was actually paid back by Black Horse?
If so you've either been lucky and they've not twigged that the loan was sold through a dealership. Or otherwise they've just paid it back as a gesture of goodwill because it's a small amount. If the other one is, as you have stated, worth much more then they are obviously going to defend their position over it.0 -
It really doesn't matter how much the figure is, but as above, if it's below the auto payout threshold, that's probably hy they paid the first time, because they didn't actually investigate.
Motor dealers were not regulated prior to January 2005, no matter what the FOS say to you on the phone, they don't and never had jurisdiction. [ this is for anyone else reading this who was sold PPI by a dealer pre January 2005]Non me fac calcitrare tuum culi0 -
In theory you might be able to if the dealer subscribed to the GISC code at the time and was later regulated by the FSA.
However that does not apply to most so your chances are virtually nil.0
