Help, shop won't return item

Hi please help. my local car accessory shops playing funny. my car was not working, and my husband was trying to fix it, he thought it was a starter motor so he ordered it paid £65 for it and collected the next night after work. That night he found it was not the starter motor that was the problem it was something else. So he returned the motor the very next night, unused. The man in the shop hummed and haaaed about it. But said he'll keep the motor and speak to the rep and see what they can do. Over a week passed and I haven't heard anything from the shop. I called in tonight and now he's saying he won't I've me a refund. So I asked for the starter motor back but he say he doesn't know where it is, it must have been put away. So asked if I can call back. This seems very shady to me. Does anyone know if I'm entitled to a refund, or credit note. Or am I £65 out of pocket. All help would be gratefully received.

    You have no statutory right to a refund or credit note.

    As there is nothing wrong with the starter, you are totally reliant on any returns policy the shop may have.

    However, having said that, of course you are entitled to either the starter or your money.
  • You have no legal rights to a refund, so if the shop have lost the item, I expect they will simply get you another one from their wholesaler
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
