No wedding album 12 months on

i am hoping some kind soul can point me in the right direction..
To be short a relative of mine got married last year abroad, she checked out a few wedding fayres and found a photographer of her choice...to cut a long story short...he took the wedding photos and then after a few months of hearing nothing the bride contacted him only to be fobbed off continously until she found out he was having financial problems and apparently couldnt afford to pay the company that was dealing with issuing the album (in italy)..What seems so unfair is that the guy who took the photos was paid in full, and that the album is there waiting to be shipped from italy but until the photographer passes on the money to them they wont ship it..my relative as even offered to pay again (so desperate is she for her album) but is being told that due to copyright they cant let her have them until this photographer coughs up..But what if he never does...his mobile is no longer in action.
any advice would be gratefully received.
Received £250.00 with one phone call to reclaim Mortgage Exit Administration£ fees AND £2995.00 bank charges from Lloyds TSb..All thanks to Martin Lewis. :T :money::T:beer:

Not quite the same problem. We went to Wedding Fayre when DD planning wedding. Booked first class (as we thought!) photographer and the photos really not good at all! He took about 14 photos of the bridesmaid (we love her but!), two of groom and best man (over exposed), none of me with DD or SIL family group pictures, only about 4 of our DD with Bridesmaid and only one with her Dad etc etc. To cap it all a lot of them were out of focus slightly or very over exposed. When we complained it was blamed on a new developing machine. However, we had a lovely day and some of our friends' photos far surpassed with their photos and we do have the memories of a very very happy day.

Just would of liked to have a really lovely album (like the samples he showed us!)

So sorry about your trouble regarding your special day and hope you can resolve something. Just wanted to give you some support

    Love

You need to tell this photographer, in writing, that 'time is now the essence of the contract', and that you expect him to come up with the album by a specific date. e.g 1st July, otherwise he will be in breach of contract and you will start legal proceeedings to recover the money you have paid to him.

I know what your saying and yes your right..but the problem is my relative is scared of rocking the boat in case she never gets her Album..what happened was she payed the photographer the couple of thousand pounds for everything, but until he pays the studio in italy they wont release the album, even if we offered to pay again, they say its something to do with copyright..The photographer admitted he is having financial problems and promised to pay in bits...but now is phone is dead..very frustrating as my niece is emigrating to oz in the next couple of weeks and is now desperate to get them before they go...it would be fantastic if she could get them in time to celebrate her first wedding anniversary in a couple of weeks time..

Unfortunately the person who owns the copyright to athe photos is the person who took then..i.e. the photographer. The photographer could sign a document stating that he has given full copyright over to X and could the printers please hand the pictures over to them.
I know that has been done before as I have done it in my former life as a photographer. I took some pictures of a local band and immediately signed the pictures over on developing (but keeping the rights to use them for my own publicity). That way they didn't need to keep running to me everytime they needed to use a shot.
