Vanquis and Section 75 Refund

Hi everyone,

I ordered an old record on-line from a company in Germany back in March. I paid £274.31 + £6.04 for insured airmail delivery.

To cut a long story short, I've still not received it. I've mailed them and they said they would look into it for me, that was the last i've heard from them.

I paid using my Vanquis card, so thought I should be protected under the section 75 policy. After speaking to their customer service, I was bluntly told that because it was over 100 days ago, there is nothing they can do about it.

Is this right?

  • They/ you are mixing Chargeback refund and a Consumer Credit Act Section 75 claim.

    As per http://www.which.co.uk/consumer-rights/problem/how-do-i-use-chargeback/ the chargeback normally has a limit of 120 days but S75 is limited by the statute of limitations which typically is 6 years

    You need to go back to them and be very explicit that is is a CCA S75 not chargeback

    However, I recently looked into this. The time limit for a chargeback is actually 120 days from when you became aware there was a problem - not simply when you made the purchase.

    However, there is also an overall limit of (I think) 540 days from purchase.

    If that is so, then Vanquis is at fault.

    Given that the seller was not in the UK, think the seller might not have realised for a couple of months that he would never get his item and have been just inside the 120 day limit.


    I agree with II, though. Go back to Vanquis and complain that it has refused your S75 claim.
