Hi.
Has anyone had any dealings with this company (guy?)
I'm in an IVA with him, and he is turning into a nightmare.
He incorrectly let a secured creditor into the agreement, and when I picked up on it, he has turned into a right nasty b$£%$%, threatening me etc. (He is now under investigation by the ACCA over his conduct). The secured creditor has now dropped out of the IVA, which completely throws everything off now, and puts my house at risk.
It also turns out that he hasn't paid any creditor in 16 months, despite me being fully paid up.
In an effort to sort this out on my own, I have offered a settlement figure, but he refuses to even acknowledge it.
Is this typical of this guy?

Never heard of them.
Sound like a right bunch of cowboys though (assuming what you say is true).
Difficult to advise further without knowing more detail: How much is your original secured/unsecured debt? Do you have property equity?
Is BR actually an option for you? If so, save for the £750 fee by 'breaching' you IVA agreement by not paying, and go from there.
Let us know how you get on.
Good luck.0 -
I also have never heard of them - i googled them but very little information on them. What is your IPs name?0

I've tried the same google approach and absolutely nothing which sets alarm bells off in my head. Write to each of your creditors - secured and otherwise and contact either Citizens advice and or a reputable IVA company urgently0

Hi DouglasS
My Googling suggests it is a Stuart Garner - is this correct?
In any case,
http://www.bis.gov.uk/insolvency/contact-us/IP-Complaints-Gateway
has information on how you can complain about an IP's conduct, though it is not a way of overturning or cancelling the IVA itself.
As for creditors not receiving any dividends so far, do bear in mind that the initial payments into an IVA will often go exclusively towards covering the IP's predetermined fees, so it may be some time before dividends start to reach the creditors themselves.
That said, the fact that the ACCA are investigating this particular IP suggests there may be some cause for concern.
