    Contact the council that covers that area or look at their website under the planning section - you can do an online search from there.

    all local councils have an online planning portal, where you can check what planning decisions have been granted, and what has been refused

    you will need the name of the road the car park/retail area is on, then the planning portal should throw up a list of all planning applications for that particular site

    Am I entitled to request a copy of the full copy of the contract between PE and the landowner and at what stage?

    If it says words to the effect "and is hereby authorised to issue proceedings .. . " does that get around the issue? Or does the landowner have to issue the proceedings in their own name?

  • Hi Guys,

    just a quick update. Despite me opting for no mediation, it looks like parking eye have ticked that option and I've been invited to take part in a mediation appointment.

    Any advice please? I don't think I should do it unless i AM prepared to pay them anything, which I am not. I was going to use it to ask for an apology and my costs back but I think the mediator may get a tad frustrated at that being my negotiating position. Hmmmmmm, tis a conundrum, what to do???

    No it does not!

    And PE won't give you a copy of the contract. Read the link I gave you earlier, please. You will learn so much from PP's blogs and the witness statements are key.

    Another inconclusive thread where the OP hasn't come back to update us - which is usually the only way we find out.

    The OP hasn't been on any part of the MSE site since April. So the chances of them seeing your question is pretty remote.

    Perhaps you could try to send him/her a PM and see what that brings.

    All cases are different, even with the same car park involved. All Judges are different as county court is a lottery - hence why our advice in post #5 of the NEWBIES thread tells you to pay the game, put in a defence, complain to the retailer management and when the case is allocated locally, go for a letter asking for the case to be stayed. All explained in the sticky thread which is your first resource, old threads aren't helpful as you can't know what will happen in your case.
