Cancelling Upgrade Contract From Carphone

Hi guys.

I am just curious to what rights I do have with this subject. I'll explain the situation.

My friends mum has just taken out an upgrade from the Carphone Warehouse which is on Orange.

She has took out their £41 a month deal with the Samsung S4.
They also persuaded her to get insurance for the phone too.

The problem is, we told her to go to the shop and cancel the current contract she was on, which was out of contract.
But she came back with this deal.

So my guess is, she went in and asked to cancel the contract, but as she is that gullible, they sold her this ridiculously high one (I think anyways)

We was going to get her on o2, which can do the same deal for under £25. But with this one, she is paying around £50 a month!

I thought phone providers offer a 14 day cooling off period but after ringing up, this do not offer this.

I know it's her own fault for being that gullible to think it was a really good deal, but is there anything we can do to cancel the contract and get her on the one that's half the price?

Any advice would be grateful thanks!

    some networks or stores do offer a cooling down period, but also some dont include it on upgrades.

    legeally, theres not much you can do now as the contract has been signed.

    you could go back to carphone warehouse and see if as a good will they will cancel, you might get lucky.

    are you sure you can get the same deal for £25/month ?

    Are they legally entitled to not tell me there is not a cooling off period?

    And yes I can, the £32 a month contract from o2 with a discount code (friend works at mcdonalds so I can get a third off the contract making it under £25).

  • Just want to point out a few things The O2 discount only works for the airtime part of plan and not the phone plan. So if you were paying £12 a month for airtime and £20 a month for the phone, you would only be saving £4, not £10.33ish

    Yeah, I have a o2 contract with the discount applied so know how it works.
    It worked out to be £22m for the airtime and £10 for the phone.
    So a third off £22 + the £10 for the phone.

    That's fine, I just didn't want you to be making decisions on mistaken information.

    It does appear that a cancelation is pretty much a no go. You can go and complain to the store, but you won't have much of a leg to stand on, she is a adult and as a adult she should know when to walk away and make decisions on her own.
