how far away from a neighbours house , do i need to dig 1m deep foundations on a conservatory , without having to worry about party wall issues?

    Either 3m or 6m depending on:

    "If you are the building owner intending to excavate within 3 metres of an adjoining building AND the excavation or structure extends below the level of their foundations; or you are intending to excavate within 6 metres AND any part of the excavation or structure falls with a plane drawn at 45º; you must serve notice (a 3m/6m Notice) on the adjoining owner, at least 1 month before beginning to excavate "

    thanks , so what i have is a lean to on the back of the house were exchanging on , which appears to be built up from the flagstones , and is in a very poor way , but one side of it , which is glass and timber , is only 8-10 inches from the neighbours wall

    I wonder if thats why it doesnt have foundations..


    I am be misunderstanding , but if the house next door has foundations deeper than my proposed replacment lean to....i still have to serve notice?

    thanks DTD , appreciated , i am unsure i understand how to interpret the 45 degree rule , and we are supposed to be exchanging this week ! half the reason we offered is based on a lean to to sit out in, wife not happy !

    the 45 degree rule is if you are going deeper than thier foundations.

    if your founds are shallower than thiers AND you are not crossing the boundary, you do not need a PWA.

    the simple way to interprit the 45 degree rule is that for every 1m away from thier founds you are you can go 1m lower than the bottom of thier founds, but you have to be atleast 3 m away.
    so for example, you are building 5 m away from them and they have 2m founds, you can build upto 7m deep without a PWA.

    obviously we wont rely on a conservatory company to ensure for us due to them probably just wanting the sale , but what expert needs to be instructed to tell us for sure , that the house next door has foundations deeper than a meter ?

    is the house the same as yours? if so you could dig along your founds to see how deep they are.

    see picture of the back to give an idea , basically a staggered end terrace , so the wall to the right as you look , is part of neighbours frontroom i think (pic 20 is best to explain what i mean)

    The companies we have in mind are well regarded and we would be happy to use them , but both say they dig to 1m if appropriate (maybe ours wont be as will only be a lean to) so i thought that might be standard depth

    Well you're certainly well inside the 3m limit, so your next step is to find out how deep the existing foundations are

    thats the thing , how would i find out the depth of neighbours house!?

    all will have been built at the same time to the same depth, so dig at the back of your house as near to the boundary as you dare
