credit file history mistakes from provident

Hi all,

I have been checking my credit file recently and started paying off my debts, as being self employed, a bad credit score is affecting the growth of my business and costing me more to run as in im trying to lower my overheads.

During checking my credit file, over the past 5-6 years I have had provident loans, I had these because obviously when I was young I didn't pay much attention to how I was spending any credit cards, always thought it was Christmas.

Provident have put on my credit file for the last 4 loans, 2 have finished and 2 are active. I pay every week and I always speak to the agent to see how I am doing, and he always says I am ahead in payments. I pay £20 a week for both loans, 1 is £5.50 the other is £13.50. so £1 extra week.

When checking my credit file I noticed the late payments on the last 4 loans all saying I was 4 months in arrears, on further investigation it says the the repayments for the 2 new ones should be £23 for 14 weeks and £75 for 12 weeks, the old ones say similar things in regard to the weekly amount.

Also on the files is says they are " DELINQUENT " which isn't the case as they have never gone to a DCA.

Where do I stand on this as I know for a fact I am not 4 months in arrears and the debts have never gone to a DCA.

any help appreciated

thanks

matty

Technically it is delinquent, as it was behind on original payments.

This isn't my specialist area, and someone will be around to help soon.

  • Thanks for reply, and as you said not your area, but they have it down wrong on the credit file I shouldn't be paying the £23 per week or the £75 per week, I am contracted to pay £5.50 and £13.50 over longer period. I have never missed a payment.

And the damage its doing to my credit score is ridiculous.
cos my negative on my credit score is 5 late payments, but 4 of them are the provident 1's that have never been late in the 1st place.

Its not a true representation of how I pay and keep up to date with all my debts now.
  • Not sure how these loans work but presumably you have signed and have a copy of the 2 loan agreements?

    What do the repayments say?

You need to complain, in writing, that either what's on your report doesn't match what's in the agreement or that the collector has asked for the wrong amount and has caused these arrears. State be also said your payments are ahead.

Can you confirm from your report that some monthly payment is being received? Do you get a receipt for each payment?

  • I have a repayment book, that keeps track of all repayments........I will have to dig out the agreements, I know I have never signed agreements what they have put on my credit file, because I know I wouldn't of been able to keep up the repayments.

If I cant find the agreements I will have to send in a SAR.

To get copies of the original agreements you can just send a CCA request with a £1 fee (per agreement) rather than do a £10 SAR.

  • well that's cheaper than a SAR, do you know if there is a template letter for a CCA.

    get it done ASAP.

There are some templates on the sitem or on national debtline website.

This is the relevant section (per national debtline) - poor formatting sorry
With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement and a full breakdown of the account including any interest or charges applied. We understand that under the

Consumer Credit Act 1974 [sections 77-79], we are entitled to receive a copy of any credit agreement and a statement of account on request.

We enclose a payment of £1 which represents the fee payable under the
    Consumer Credit Act 1974.

We understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days.

    We understand that under the

Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act.

  • just 1 last question, I can only send a CCA letter for active accounts, as I have 2 active accounts would it be best to send 2 letters and also I don't know my account numbers for the 2 active loans, I can only see the last 5 digits of the account numbers on my credit file.

    thanks
