Challenging a default

Evening all.

Ive just signed up to noodle after reading about it on here. I was having a nose at my closed default but settled accounts. Ive noticed the Barclays plc have placed a default on my file almost 2 years after I entered my dmp. I'm not saying I don't deserve the default, I do, but applying it almost 2 years later takes the mick. Is there any thing I can do to challenge the date?

    Yes, you can write to them and tell them that the ICO guidelines state that a default should be applied 3-6 months after you started your DMP. I've had one date changed through this, and I'm currently awaiting another one.

    Be sure to mention that you'll be taking the matter to the ICO and FOS if it's dealt with in a timely fashion.

  • Thank you both for your replies. Like I've said all my defaults are deserved its just annoying that I have to wait an extra year for it to drop off. How would I go about wording the letter?

  • What was your min payment?

    What were you paying them on the DMP?

    Did this amount change around the time the default was applied?

    This will help with figuring out what to put in the letter.

    I was paying £165 a month before the dmp, then for the 1st 2 years paid around £50 month. At the time the default was added, I increased my payments to all creditors and I was only paying about £10.00 per month less than my min payments before dmp. I had 3 accounts with Barclays which defaulted, the 1st in 2009, 2nd 6 months later in 2010 and the last 1 defaulted 2 years after the 1st and 13 months after the 2nd.

  • I would argue that:
    -defaults with same bank should be issued consistently when all accounts in DMP. All at the time of the first.
    -no reduction in payments at the time the default issued so you can't understand why they did it.

    I would try and also get the 2nd one moved earlier, to within 6 months of start of DMP.

    No joy after 8 weeks refer to FOS. You have nothing to lose.

    The DMP in itself will have a detrimental impact for some time.

    Certainly worth arguing then, as if all accounts in the DMP were defaulted then backdating the last default would give you a perfectly clean credit file without any trace of the DMP whatsoever at least 13 months earlier than would have been the case.
