Ombudsman PPI claim not fairing so well.

    I have no way of proving what was said at the point of sale, the adjudicator fell short on a number of other points, the suitability of a single premium policy, around affordability and the fact that the insurance policy was sold on an advised basis and failings there, I also raised the point that FSA had fined the group who sold me the policy in relation to its PPI sales practices at the time of my particular sale. Again as said appreciate that aspect may be a loosing battle.

    However I note that there are major inconsistancys around what the company in question believe I owe as per paragraph 4 of my original post and would appreciate your views as this is showing on my credit file. Do the courts deal with such descrepancies? The company in question obviously have no intention in taking me to court but if the £2000+ was reduced to around £700 I would be more inclined to pay.

  • There's nothing to stop you taking it to the end of the line withe the FOS. Ombudsmen do sometimes overturn adjudicator's decisions and some adjudicators are a bit rubbish - but they can also only consider the evidence presented to them by both sides. In the absence of evidence the FOS has to consider what is most likely to have happened so all you can do is present your side of the story as strongly and with as much detail as you recall and remain consistent. I've had an adjudicator rejected complaint upheld by an Ombudsman, so it does happen and you get ample opportunity to add additional information and re-iterate your argument as strongly as you can - my complaints lacked evidence on both sides, and was upheld because the Ombudsman ultimately decided they believed my version of events over the banks (and because the adjudicator was an idiot quite frankly). Statistically, however, it remains unlikely to go in any complainant's favour at that stage. If an Ombudsman doesn't uphold your complaint you still have the opportunity to then go to court, if you want to, but PPI doesn't really belong there. Reducing the debt may be a different issue. Go with what you believe is the right thing to do so whatever the outcome you know you gave it your best shot.
  • Thanks Taff, they defaulted it in may 09. I get the odd dca letter about every six months but nothing more. Just a shame I've got to wait two years for it to disappear as its the only negative on my credit file and obviously it's a biggy. I have letters from said company thanking me for enq about volantary termination and there acceptance and all paperwork regarding collection etc. they defaulted in may and immediately it dropped from the redicilous heights of £10,000+ to this figure of 2200 which I'm convinced they plucked out of the air.
  • Thanks miss chicken, that was my opinion on the adjudicator in my case after speaking with him and there's a few websites showing not only the failings of the adjudicators but also the ombudsman service. I shall wait and see.
