    You could indeed sue Lidl for the loss, plus extra for damages & distress; I suspect they'd pay up rather than have a court claim in the public domain. You'd need to send a Letter before Claim first and then do a MCOL claim.

    Send a complaint to Lidl on this, you should have done this in any case. Tell them you are a customer and their agents took you to court without their authority you think, and you want confirmation of the authority they given to parking eye for this.

    Inform them that you want the £85 back, otherwise you will issue a small claim against them for the below

    £85 - for payment to parking eye
    £150 - for dealing with this and research
    £100 - compensation for stress
    £30 - Court fees

    Plus interest at 8%

    See if that wakens them up, if it doesn't then consider a letter before claim. Basically you have nothing to lose

    Hang on, I just realised this is Lidl and they use Athena. So if the car park was covered by Parking Eye, they were more likely IMHO to have been contracted by a managing agent of a retail park. Not just a Lidl car park - the OP says 'the usual 2 hour max stay car park. Whilst doing the last shop in Lidl...' so this was not Lidl's to cancel.

    This would have been the Managing Agent's case to cancel - and maybe they would have done...were they sent a complaint?

  • They weren't sent a complaint no, and we did get 3 or 4 pages of spiel and witness statement and I'm 90% sure we had something in there about landowners. Maybe Fletcher King? I dont have them to hand. Lidl share the carpark with Argos, Iceland, Store 21 and another.

    Its all been filed away now, I may complain to lidl in writing see what they say. I've lost heart in it, with it being Christmas, drawn a line under it.. it's £85 less that the shops will get this year I'll tell you that..

    Complaints are the way forward for you, basically you have nothing to lose as it's been paid, obviously ots up to you, but you do have 6 years to do this, take the Christmas period off and come back to it in the new year if you want
