Car warranty invalid what can we do?

Help! Saturday we part-exd out car for a used Kia, persuaded by the peace of mind from the 3+ years warranty still left. We made sure to understand how we could keep the warrant running, the sales guy explained service had to be main dealer or vat-registered garage with genuine Kia parts and receipts for them kept, body work should be inspected every year by Kia dealer.When we got it home and looked at the documents shocked to see
1) First service should have been at 12 months and it was done at 20 months. Next service was done 16 months later!
2) No proof of Kia parts being used, not main dealer service
3) Body inspection not done in Year 1 or 2 and late in Year 3 So, assuming warranty isn't valid. Phone the sales guy Sunday, he thought it was all OK as his company had just serviced and inspected the car and he says warranty "resets" when the car is sold. This was such **** we started to get really worried.
Today even if Kia or the dealer ever phone back not even sure what we can hope for .. at the moment we don't have our old car, we don't have the car we thought we'd bought or the money we paid, we don't have the money we spent on road fund licence and plate transfer and we definitely have no peace of mind. Help?

    I take it you didn't buy it from a Kia dealer?

    If you did, I would ask for the response about the warranty 'reset' in writing.

    If not, assuming that is a bogus bit of info, I assume you want your money back? You could ask for a partial refund on the basis that the car is not as described I suppose. A tough one, you might have to come down heavy on them.

    Yes bought at Kia dealer. Just want the car with the warranty really, one from warranty direct would cost £1400 but that wouldn't include bodywork - but how would we get our money back?

    Sure someone will be along with more information in a moment but there are a number of things you could try.

    Mainly that the car was not as described, (Sale of Goods Act) and that if you based your decision to buy on incorrect information.

    Do you have a copy of the advert or anything written which says FDSH or balance of warranty?

    most importantly, have you chased Kia for a decision on whether they will honour it or not?

    I'd be concerned generally that the servicing wasn't done on time or to spec. The car might well last the warranty period but after that you could start seeing the effects. Plus, your re-sale value maybe lower.

    Good news though as it is a main dealer at least you can batter them with Kia which you wouldn't be able to do if it was a backstreet operation.
    What if there was no such thing as a rhetorical question?

    Didn't think for one minute that a main dealer would be selling own make cars without proper service history. Car was found using Kia website search. The point about the servicing effects finishes it, how do we get out of this nightmare and get our money back?

    If it is a main dealer I would relax a little. This changes things.

    Get them to confirm in writing what they have verbally said. If they refuse, call Kia UK and report their actions, stating that you have been mis-sold the car. They will want to know if they have a dodgy dealer like this - I know of a Honda dealer that got struck off for a pattern of behaviour like this.

    You obviously like the Kia so the easiest way out maybe to put some pressure on the dealer for your money back but give them a way out by swapping with something else they have.
    Just check the service history etc. first
    Change is inevitable, except from a vending machine.

    Thanks guys, starting to breathe easier. Just feel proper stupid, we though we'd been sensible but we trusted a car dealer....

    Don't blame you for trusting them. Ask for confirmation that the car is covered by the warranty and that this is guaranteed by the garage - as you asked about it prior to purchase in effect you have made it a condition of sale so they can either honour it or refund you
