virginmedia giving me hassle

Hello. I have been with virginmedia for over 4 years now. i am on a 30MB offer, and as far as i was aware i am not tied down into a contract. last May however i got offered a deal. pay 2.50 pounds more and double my speeds to 60MB. the catch was after 6 months my bill would go up by 5 pounds. This was a 12 month contract i agreed to over the telephone. when my services changed to double the speed i did not notice much difference and called up and changed back to 30MB and went back to paying my normal bill. as far as i was aware i have cancelled the agreement of 12 months for 60mb. and to this date i have been paying my normal bill for 30mb.

now... i have joined with Sky. got a really good deal of them plus over 150pounds cashback. that is being installed end of sept. so i called virginmedia to cancel my contract. they refuse to cancel my contract without an early termination charge as i agreed to a new contract in may...

i disputed it, that i cancelled this contract. 60MB for 12 months. and told them there is no contract between us and asked them to send my this contract in the post.

can they refuse to cut me off without the fee though, considering i did not take out their service. i orderd it orginally the PHONE so i have distant selling regs right? of how long though...

any help would be much appriciated, really want to leave them especially after this treatment. :mad::mad::mad::mad::mad:

    you would have been on a contract for your 30MB ( may of been month by month) so you upped this to 60GB to a new 12 month contract. you then cancelled this and went back to a 30GB Contract.

    this would not have been going back to your old 30GB as that was cancelled when you upped to 60GB, so you are now on a new 30GB contract which would be a standard min.12 month contract

    I would have thought that this would be classed as an instantanious service, in which case the DSR wouldn't apply.
