update to my last post about my car
Basically bought car and before purchase they agreed to sort dent on collection it wasn't done, so they booked in to do
Job was attempted twice with fail
On receiving car back there was broken paint around window seals and over spray oh and colour match
So complained to dealer who past comments back to bodyshop
Later that night bodyshop owner phoned me at 8.30pm and verbally abused me
Told dealer following day who said to meet him as his head office bodyshop Allen Ford
So went with dealer telling me it'll have to do as the bodyshop said that's best they can do. I moaned that wasn't happy. They said thought they weren't prepared to do again, but did give me a tin of cutting compound to do work myself.
Made a complaint to there head office and await outcome
Since then bodyshop owner has had a solicitor call me directly which I'm not happy with.
Body shop gave my personal number out, details of car and issues and my name and address, had wordsmith solicitor who told me he wasn't acting for bodyshop which I said he was as on phone to me.
Anyway passed his info on to a barrister of mine to call this solicitor direct.
1 he later solicitor calls says sorry and bodyshop agree there work and behaviour was below an acceptable standard. Letter of apology in post and flowers for the wife
But still left with a 2 tone car

Times and dates between purchase and repairs? How long have you had the car? How much use have you had from it?

Ahh yes i remember that one.
Reject it..
Do they have another car of the same value? Or even slightly dearer. Tell them you will take that one instead.
Check it needs no bodywork repair 1st.

They have nothing there of similar value that would be affordable to run
They have rang me today basically blackmailing me, telling me not to pursue the claim or they would be forced to take legal action
I did question what they would be needing a leader for as I've done no wrong.
He had no anwser
He tells me we signed a form on collection that we were happy with the car and this means we have no leg to stand on, personally can't remember any such form being signed.
I called there head office and spoke to lady handling complaint who took on board this latest call.
10 mins after that call to head office he calls me again from dealership telling me to atop ringing head office
I said I have every right as a consumer to make a complaint and will pursue as far as I can
He called back again saying if I take car along to him Thursday and wait he will have his head office bodyshop guys in to do what ever work on car on want and how I want doing.
We paid 8200 for the car about 2 months ago, we have done around 500 miles in the car during that time as in total the car has been with dealer for 2-3 weeks of us owning it.
I'm now at point if I say I want to refusethe car I will have him firing the threats.

Letter before action... formally rejecting the car or refund £££ to get your own bodyshop to repair the car.
Start recording their phone calls. Or refuse to speak to them on the phone. Make a note of the time and name if possible and just say IN WRITING and hang up.
Contact the finance company also and explain the faults with the car.

Previous legal cases (as pointed out in another thread by a poster whom I can remember the name off, will do a search shortly to give them credit) have found it reasonable to allow up to 3 repair attempts in cases where you are considered to have accepted the vehicle.
So should be a fairly safe case for you here.
You've stood your ground, batted off their threats by using your barrister and going above their head to complain. As well as my caving it to their moaning about you going to head office etc - well done for that! Many would have given up long before now.0 -
Complaint to the head office was made via email.
My biggest problem I have is proof
The car has only been worked on by a back street garage that has the dealer wrapped round his finger, car was inspected via Allen Ford main bodyshop but I've received no estimate of repairs, where this shown the car needing around £700 of paint repairs to sort all the issues. This hasn't came as yet and probably never will, company covering there tracks
I will allow garage time this week to look and try and fix the issues, if they are unable I will write again to the managing director along with a independent inspection and will also notify the finance company of the issues.0 -
