    Shes always wanted to be a midwife but it would of been her decision to go for it not the employers saying were short here etc, afarid I don't know the ins and outs of it but I can see what your saying is if the employer agrees to the re train then she should be entitled? Although I suppose thats all down to interptation?

    It doesn't sound to me as if it's as simple as just the employer agreeing to it. The reason for the retraining has to be " for wider service or operational reasons", not just the personal choice of the employee.

    Shes been a nurse for over 10 years prevouisly, so I would think so! :)

    Don't advise her to engage a solicitor as this is likely to lead to her union withdrawing assistance. If she needs legal advice or representation this will be accessible via the union. Bear with the rep, it can take a long time to get answers or information from payroll dept etc
