Mobile Phone broken - contact retailer or insurer?

Hi,

My 15 month old Samsung s3 wouldn't power on since last night. I'd been using it all day without problems, the notification light was flashing, but when I tried to check it I found the phone won't do anything. Tried all the usual things to reboot.

It's only 14 months into a 24 month contract so I think should be covered by the sale of goods, but I also have insurance on it which covers theft, loss and damage.

My first thought is to contact the retailer to repair or replace as the phone has always been gently treated and I would expect a phone on a 24 month contract to be of sufficient quality to last at least 24 months.

Does that sound right to you guys?

  • Yes, any claim you make under the Sale of Goods Act will be against the retailer. As its more than 6 months since purchase they may require you to prove the fault is inherent. Contact the retailer and see what they say.

    Being 14 months into the contract is irrelevant as the handset and contract are two separate things.

    The good news however is samsung have a 2 year warranty so contact them, as thats all your provider will do anyway after mucking you about for a couple of weeks.

    Personally i'd just cut out all the hassle and go straight to the insurer. After all that's why you purchased it right? Of course you do have rights with the retailer, but it could be more hassle than it's worth if they ask you to prove the fault inherent.

    But then i'd also be willing to pay a few quid to post it to them for an easy life, which many wouldn't.
