    Hi,

    Some cold radiators would not be a serious issue for me; they are right to say that you must get it looked at before exchange, but as it could be something as minor as the radiators needing bleeding, I would not panic over that just yet.

    However, the rusting water tank would worry me more, as it is obvious that it will never get any less rusty! I would either negotiate a reduction in the price to take into account the need to replace the tank, or ask the seller to replace it before exchange: then you would need to agree a spec. acceptable to you.

    Don't bother asking the seller to replace the tank before exchange. Would never happen. They could do that, then you pull out and....

    if the seller wants to sell his house surely its in his interest to have the boiler replaced or any other survey problems,
    they are selling regardless if the OP buys it or not

    or is it just me , any problems with my property I would want to address, unless its been noted and considered in the price
    buyers could pull out but I still want to sell

    Some People deliberately sell houses that need work. If they're doing that, then their plan is to do nothing. There are many reasons for that - lack of money, divorce, illness, debt, death...
    Everything that is supposed to be in heaven is already here on earth.

    In reality it's the opposite in my experience. Hide what they can, then you find out when you move in what hasn't been picked up on a survey.
    I would never do anything to my property that costs money at the request of a buyer before exchange. I have been dealt the blow of pull out on exchange day, so have others, so many would not do this.

    You left out 3 - laziness, deceit and criminals


    I've been stung by this. Leaking roof, broken oven, sinks blocked etc. the sellers went to Australia and left all debts behind totalling £40k that I know about. So they were all 3 I mention.
  • I spoke to the EA on Tuesday and advised the issues raised in the survey. i.e. that the water tank is rusting and needs replacing and that some of the radiators are not working. They asked of the mortgage offer was being reduced due to this and I said no, the market value placed on the property is the same as our offer.
    The handler said she will contact the vendor and call me back.

    I hadn't heard anything so I rang the EA today. The handler dealing with it wasn't in so spoke to another lady.
    I asked if they had spoken to the vendor. She said there's a note there to say the issues found but that the value was the same as the offer, so "what was it that I was after" was her exact words.

    So I said we wanted these issues looked into and want to know what the vendor will do re these issues.
    She said she will let the handler know tomorrow.

    Just want to know, because the surveyors valuation is the same as our offer with these issues, are we not supposed to ask for the said issues to be resolved or price reduced?

    Thanks for any help.

    The EA will call the vendor and say "the buyer has got a valuation showing he is paying the correct price for the property taking everything into account. However he seems to want you to install a new water tank, boiler etc. We would advise you not to do this. What shall we tell him?"

    In due course you will get a response along the lines of: "the seller feels the property is priced correctly, and your own Valuation has confirmed this, so they are unwilling to either do any work or reduce the price further. Do you wish to proceed?"

    You will then have to decide whether to withdraw from the purchase or continue.

    Depending how much you want the house, and how you feel about the price, either

    * withdraw and start house-hunting again or
    * budget to buy it and then replace the boiler, heating system and tank and have a brand new system that will last out your life-time in the property.

    How did you get on?

    I think this case serves us a lesson in not declaring to the EA the detail of the survey. I would not even use a surveyor that the EA recommends, as wouldn't really be convinced about the impartiality of the report.....

    I would say to the EA that you are happy with the survey, but because the water tank needs to be replaced, you will lower your offer by £x (the average cost of replacing the tank). If they don't like it, look for something else.

    I hope this is not too late and is of some help to you.
  • would you go with a developers recommended solicitor? (conflict of interest maybe?)
