Tree Surgeon damaged fruit tree

Hello
Would appreciate some rapid advice as I'm going to meet the tree surgeon at lunchtime today to negotiate payment!

We arranged for a tree surgeon to remove 3 very large Leylandii trees from our property - we've just bought it and they were massively overgrown. A three day job to remove them, we were told...

Anyway the tree surgeon told us a) there was good access so no problem with removing the trees and b) he would take down the trunks in pieces after removing the foliage and chipping it.

All was going well until the last tree which they've felled in one piece after taking the foliage off - and the top of it landed in and removed a good portion of our (only) mature pear tree, which was some distance from the Leylandii (there is space to park two cars between the Leylandii and the garden with the pear tree)

This was totally unexpected and pretty annoying for me, and very upsetting for the head gardener (SHMBO :-) ).

As luck would have it I had set up a stop motion camera to record the tree removal for posterity; and it clearly shows the action occurring.
I don't want to bring this up in negotiations unless I have to, but at the end of the day we have access to the internet and footage of the arborist c*cking up.

So, what kind of discount should we be asking for? The work was supposed to cost £750, but they've also damaged some brickwork that was at the base of the trees, and the pear tree is quite a big deal to us. (and they were done in 2 days, not three!)

The bloke seems nice enough, I thought he was a decent guy but he is acting surprised at the damage, but I can see he cut the tree down himself! They've also cut off a number of the damaged pear tree branches so can't claim they didn't notice...

Your thoughts most appreciated!

  • depends on
a/ whether you want to use the tree surgeon again
b/ how much damage has really been caused, will the Pear tree recover?

as obviously you cannot repair the Pear!!!

if the Pear is not too bad I would start at 50% but be prepared to pare him down to 75%

    lots of Pears there !!

He should be covered by insurance for this kind of accident.

Which will have an excess of £250 to £500 ish so for the value of the damage the OP may as well negotiate on the price
