Bought a used car - what protection do I have?
Hello,
I bought a car last week which I hadnt seen and all is fine apart from a few minor issues, this car was bought from a large franchise of car dealers. I bought from them without seeing it thinking that they wouldnt sell it with anything wrong and if there was, their backup would be good enough for them to fix it for me.
Theyre not exactly playing ball which has lead me to wonder what sort of protection I have from OFT, etc. if these issues dont get fixed.
Firstly, I bought the car over the phone without seeing it. Does this mean im covered by distance selling regulations which means I can return the car for a refund?
Secondly, it was advertised wrongly - it was listed as having features it doesnt. Can I pull them on this for false advertising?
The salesman promised some cosmetic damage wouldve been repaird (scratches, a dent, etc.) but it turns out that in fact it hasnt, despite him promising this. I dont have it in writing but it seems like theyre going to keep passing the buck on this until enough time has passed until they can wash their hands with the car.
Unfortunately I didnt pay with a credit card but certainly will from now on!
Is there anything else I can do?
Thanks in advance

I don't think you need me to tell you just how bad that idea was. But I'm sure others here will.
That aside, distance selling regs don't apply here. You didn't actually buy the car mail order/online and have it delivered. I assume you actually paid and picked it up. I'm sure a used car is exempt from that anyway.
If the car is missing significant features that it is described as having, then yes, you probably have a case.
I'd start by badgering the dealer, tell them straight you want a refund or you will be reporting this as Consumer Rights breach.
Use the MSE pages on Consumer Rights to get your facts straight first.0 -

In fairness, had I seen it I probably still wouldve bought it and apart from a few issues it is fine.
I did have it delivered, the dealer delivered it a few hundred miles and the first time I saw it was when it pulled onto my driveway!
The thing is, I dont want a refund, just the issues to be sorted because apart from that its a great car and im happy with it. I just dont want to threat with legal action if they know I dont have a leg stand on, so just wanted to check what action I can take.0 -
What are the minor issues.....is it still fit for purpose?
What features are missing that were advertised?
What is the car, mileage, age, price, was it cheap enough compared to others?"Dream World" by The B Sharps....describes a lot of the posts in the Loans and Mortgage sections !!!0 -
