Which? Legal Services

Hi,

I'm really struggling with my case against a second hand car dealer who sold me a car for £4,000.00 at the beginning of July. Since then i have had 3 major engine failures. I am trying to claim a refund which they insist they do not offer. They will not communicate with me in writing - very frustrating.

I am wondering if anyone has any experience with using Which? legal services. I could do this small claims stuff myself but i want to know the best and quickest way to get this resolved as i have a full time job with no car ( and subsequently no time considering my commute is now over an hour as opposed to 15mins in the car) :(.

  • Do you have legal expenses attached to your home insurance? If you do then they will not only give you advice but represent you if they feel you have reasonable prospects of success.

    I would guess they have outsourced their legal advice line to one of the same organisations that insurers use for the same. Ultimately my guess is that they will tell you to send a letter before action giving them a reasonable number of days to resolve the matter or else you will issue court proceedings.
  • I have decided to take their yearly service of £86.00. Hopefully I will get a tailored service for my case. It's reassuring knowing there is a trained lawyer advising me rather than the impartial view of the CAB. That said, CAB have been extremely helpful the past few months and I would not knock them!
    Thanks for your reply II. I imagine the same outcome you predicted will occur and I will post my findings here once I get resolution if anyone else has a similar dilemma in the future

  • At £86 it makes the insurance companies £30 a year charge look cheap :)

  • Are the smalls claims court fees not subject to the type of case and the monetary value of the claim?

    From this .gov.uk page it looks like the fee for your case would be £100 if you used MCOL.

    As is says on that page, there may be further fees if a hearing is needed, or enforcement is necessary, but generally those are added to the claim if you win.

    How did you get on with your case and can you post your experience with Which? Legal service? I am thinking of making use of them for a case.
