driving instructor franchises

Was working for north east driving school who try to make you work 90 days notice but don't give you any work during it and still demand their franchise fee. This leads to terrible financial hardship and forces the franchisee to leave before notice is complete. The company then say you are in breach of contract and take you to court for the unpaid franchise fee and late payments fees.
For anybody in a similar situation please be aware of and use section 3 of the "Unfair Contract Terms Act 1977" as a lot of franchisee's are panicking and paying up.

  • As this is a business contract and not a consumer one the level of statutory protection is massively lower, though some of the UCT can still apply dependent on a number of tests.

    What does the contract state about the provision of work? If you think giving 3 months notice with no work was unfair, why did you not raise it before signing up to them?
