Ebay order cancelled before delivery

I cancelled an order for a sofa before it was delivered.
They had dispatched it however and say that I still have to pay postage and that I don't get a full refund, according to DSR - is that correct?
However I did not received the item. Ebay was a bit confusing because I had already paid for the item, I had to "submit a return"
I cancelled it btw because it was smaller than you would expect for a 3 seater sofa-bed. I should have checked the measurements, but I never expected a 3 seater to be 160 cm long!

Distance selling regulations apply. You have 7 days to cancel the order. You are entitled to a full refund. While the vendor is enttled to the return of the goods, you merely have to make them available for collection. You don't have to actually send them. But you do have to make them available so the vendor or his agent can pick them up.0

If the DSR applies then full refund is required from the vendor for the item including initial delivery costs.
The cost of returning the item depends on the terms of their Returns Policy. By default its their cost but they can legally make you responsible for paying it.
If its been dispatched but you havent received it yet then simply refuse delivery and it will be returned to them at no cost effectively.
Obviously this depends if the DSR applies or not. Where is the vendor based? Was it listed as new or used? Was it an auction or a Buy It Now?0 -
