Next month, will be a year since I had a car crash where I was traveling on a roundabout in the middle lane, intending to take the second exit, (which has two lanes)
where a driving instructor in the left lane, stupidly decided they were going to risk it and basically undercut me and hit my near left side quater damaging my door.
An independent witness who was behind us seen it all and gave a statement giving the version of events which puts the driving instruction completely at fault.
So why is it taking so long to sort out? The driving instructor is denying responsibility and is also claiming for personal injury
The case was, or is in mitigation the crap lawyers have submitted court proceeding letters around two months ago, they say.
Should I be phoning them up everyday until it gets resolved, I can't get insured with the prices at my age for a 50 - 50 fault or 100 percent fault, but can with a non at fault claim and 1 year no claims which I should get after this is resolved.

If it is in the court system now then there is little that can be done beyond waiting for the courts to process the case and that will take a fair amount of time depending on just how busy the local/ allocated court is.
An independent witness does not apportion blame, they simply state what they saw happen. The judge/ liability experts etc apportion the blame based on what is stated as having been witnessed.

My solicitor have sent them a part 36 offer, holding third party 100% liable. Hopefully things will be sorted soon, as they have 21 days to respond to the part 36.0

My mum had a claim going over 2 years for a totally not at fault claim.
Sometimes insurance companies are just slow. Best to leave them to it. Just reply to the letters or pass them to your insurer as appropriate and move on.Censorship Reigns Supreme in Troll City...0
