Help with our rented house please?

Hi all,
My mum and I currently rent a 3 bed house through a letting agency. We have an Assured Shorthold Tenancy agreement which is due to expire on 29th Sept 2007 (we already have a notice requiring possession/section 21) which were given with the agreement). On this date we would've been in the property for 18 months.
We have indicated to our letting agents we will probably be moving at the end of the agreement as the house isn't in a very nice area and the people who live over the back of us are very noisy. However, we haven't confirmed this.
The property is a fairly good state of repair apart from the conservatory, it's been bodged basically and the roof leaks in about 4 different places. They got a quote to repair it and it's going to cost £2500 for a new roof. So the landlord has said if we do move out he'll probably sell the property as he doesn't want to spend that kind of money on it! He owns a number of properties and doesn't seem to want to spend money on them. Our aerial has been loose for a while now, not fixed. The guttering fell off the conservatory the day we moved in, not fixed. Sink isn't sealed and the kitchen cupboard is rotting, not fixed. All this despite us nagging the agents and us having had 2 inspections. We've improved the property, we put down a new hall carpet as the one that was there stunk and was filthy, same for the downstairs toilet one.
My ques is, we had decided only to move if we found a new house which we could stay in for a few years and ticked all the boxes (this would be 4th move in about 3 years due to previous landlords selling the house at end of the agreements) but now it would appear we have to move anyway.
Do we have to wait til 29th Sept before we can move?
If we move before then, do we give 1 months notice? Or are we liable for rent until 29/9?
The agent charges a fee of £95+ vat for each renewal :eek:

Check your AST for a break clause - some have 6 month break clauses. If you have one, you can move out then with one month's notice.
Otherwise you're stuck until 29/9
However, you could tell the landlord you plan to stay on at the end of the term if he fixes everything. Try not to do this in writing, but if you do, make sure you put it in terms that render it meaningless.
So: "I plan to stay on at the end of the tenancy" would be good, because plans change, don't they? Though you might find once everything has been fixed it's nice enough to stay."Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.

You can move anytime but you will probably be liable for the rent till 29th Sept. Should you move out earlier technically the landlord should relet the property and only charge you rent till the new tenant move in, but as the landlord isn't planning to relet I don't know where that leaves you. You could try negotiating with the landlord I guess but it doesn't sound hopeful.If we move before then, do we give 1 months notice?
Not unless the landlord says you won't have to pay all the rent up to 29/9. The landlord has already given you notice to leave on 29/9 (that's what the Section 21 is).Or are we liable for rent until 29/9?
