Poor repair service

Hello there,

A couple of months ago i had a re-conditioned gearbox fitted on my MPV, i paid £900 for it and it came with a 6 month guarantee.

Not long after i collected my car i needed to Declare the car (swarn) off the road for financial reasons. I managed to re tax after 6 months. After a little while driving it i noticed a problem with the gearbox again. I took it back to the same garage and explained the car has been used for less than 6 months from the first repair. But after the garage owner messing me about for 2 weeks, they corrected the problem, but charged me another £400.

Do i have a case for a refund?

    Depends what the problem was.

    Was it a faulty gearbox or another issue that may have been caused by sitting idle for so long?

    No. You wouldnt. You would be appealing to the goodwill of the garage, but i wouldnt hold out much hope.
  • yes the gearbox was faulty, and faulty when it came out of the garage the first time. I have paperwork to prove the dates of purchase and when car was sorn of the road, and also when it was taxed.

    Your post is short on detail re times & actual faults but presuming the garage both supplied & fitted the gearbox then SoG applies and it should last a reasonable amount of time.

    Ultimately a court will decide but I'd have said that for a recon (rather than just 2nd hand) gearbox reasonable time would be between 6 months & a year so particularly given your car was laid up for 6 months I'd say you should get a refund for the recent repair
  • I'd try and find out what was wrong the second time around. If it was a faulty gearbox and it needed replacing, then i'd want to know why it cost a lot less than the last one. It may have been something gearbox related and not the actual box; clutch, flywheel etc and not something that was replaced the first time round.
    If it did require replacing again, did the first invoice state the mileage? you've got the receipts for tax and SORN but if you're trying to get a refund then proof of low mileage on the box would back up your case that it was faulty when fitted.

    No, your first post says you noticed a gearbox fault when you put it back on the road, your second post says the car was faulty straight away. If the second one was true, why didn't you take it back there and then? Otherwise, your out of the warranty period and the repairer will wash their hands of it.
  • Hello scheming_gypsy, yes you get it, that is what the issue was.
    You always get people that split hairs no forums don't you. haha

    the car did not have many miles of usage before the car had to be sorn off the road. We have paperwork with dates and millage to say the car has not had nowhere near 6 months worth of use.

    But unfortunately, the car was repaired in Ilford, so no one round there is going to admit the truth, They are all crooks.

    Still no answer to what failed the 2nd time around and how that related to the gearbox they fitted?

    So what actually failed the 2nd time?
