Because that is exactly what the parking scammers do, the POPLA kangaroo court will be dragged to heal and looks like it may have been as they instruct parking firms what "evidence" to include.
Are we are forgetting, thse are not real parking fines, they are unwarrented demands for unlawful penalties, that is dishonest and a lie from the start .
You deal with such people not by "lying" but by only presenting evidence that is in your favour, this is how any solicitor or barrister will work on any case.
They say you had no pass, you send a copy of the pass, they say it was not displayed, you leave that for them to speculate only.
It is basic common sense not to offer evidence which can be used at a later date in court.
Make no mistake here, the POPLA 100% successes rate wont last, they are dealing with it and they will deal with it or POPLA will be replaced with a another kangaroo court owned by the BPA.
The POPLA exploitation will end, very soon if not already and a barrage of what next as parking firms use the evidence supplied to popla to move to county court.
This is why, you should not include anything they can use against people at a later date.
Present evidence that is in the favour of the parker and let the parking scammers prove their case but certainly do not help them to do it.Be happy...;)0 -

Which is exactly what we do.
The difference between our advice and yours is that we do this without any need to advise people to lie or be dishonest in their response - and contrary to your assertions, solicitors and barristers take exactly the same approach in court.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

They've sent this more than 3 months after the parking event? Well that's not compliant with PoFA 2012 giving them the right to pursue the RK, so they only have the driver to chase.
I'd write back to them stating they have missed the deadline to pursue the RK by x days (count from day 56 after the parking event) and tell them they now have no cause to be contacting the RK in the context of this PCN. Either cancel the ticket or issue a POPLA code where your appeal to POPLA will cost the PPC £27.
In parallel, and very importantly, you also need to raise a complaint with the DVLA and BPA (see email addresses in the NEWBIES sticky) that they are pursuing the RK beyond the PoFA limits and ask them to investigate this complaint.
Also in the complaint to DVLA, ask them the date on which the RK's details were requested - the PPC only have until the 28th day after the parking event (counting that date as day 0) to request your details - this is a very important piece of information to your further strategy.
DO NOT IN ANY OF THE ABOVE CORRESPONDENCE GIVE ANY INFORMATION ABOUT WHO MIGHT OR MIGHT NOT HAVE BEEN THE DRIVER.
Come back to update us on how you progress. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

@Kazire
Before following my advice in the previous post, can you please confirm who the PPC is that is writing to you.
Full name and address of the PPC, please.
I've just been checking the BPA AOS and can't find reference to either of the names you've mentioned above. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

They are IPC members

This changes things slightly as we dont have any information on winning IPC appeal points yet.Dedicated to driving up standards in parking0 -

Interesting, but they have still failed to meet PoFA requirements, [STRIKE]and at the date of the issue of the NtD I'd be pretty sure they weren't IPC members then.[/STRIKE] - scrub that, they joined 1/8/13
I think an answer to the complaint to the DVLA will be quite enlightening.
Also, it would be interesting to see a scan of their NtK - @kazire, could you scan and upload a copy of the NtK please (both sides if appropriate). Please note, we are not a legal advice forum.
