DABS return gone bad

Ok I seem to be unlucky recently, bought a new hard drive from dabs and it formatted fine but when going to use it it kept messing up to the point it failed to be recognised by pc without a reboot.

Before anyone says I have been building pcs for 13 years and have qualifications in it.

Basically they did issue a RMA and the item was collected last Monday and received Tuesday and they have been ignoring all emails since until today when I mentioned I would go to Ebay(it was Dabs Outlet and paid by paypal) and they said it takes around 2 working days to be processed and 5-7 working days to get checked.

I am not happy with this as far as I am concerned I have returned item and they should refund rather than making me wait

  • They're not going to refund an item returned as faulty before they've tested it. They'll also have more than your item to test so you have to wait the time stated (probably) in their Ts & Cs

    Or perhaps more importantly, when did you receive your purchase?
  • Bought 28th August, sent 29th, received on the 30th and contacted company same day to mention issues, collected Monday 2nd received Tuesday 3rd by them.

    OK, always difficult to know whether to use SoGA or Distance Selling Regulations when an item is found faulty so quickly.

    Under DSRs you have seven working days, starting with the day after delivery, to cancel your order unconditionally.
    This entitles you to a refund of all monies paid, and that payment should be made as soon as possible but definitely within 30 days.
    If using this process you will probably have to initially pay for the return postage, but as the goods are faulty, they should cover that cost too.

    If using SoGA, as you appear to be doing, there is not specified time limit for the refund, and as mentioned above, of course the seller is justified in confirming the thing is faulty before refunding.

    As today is only the sixth working day after delivery, I suppose you could send a written DSR cancellation to DABs.
    That would remove the need for the disk to be confirmed faulty, but does allow that 30 days for a refund.
  • 10 days on and still nothing, did open a Ebay dispute and they just responded today saying they confirm they have item and promise to get it tested within the next 3 working days though that is same thing they tell me each time I contact them
