Just a quick question, could someone let me know if a person can still be eligible for Contribution based ESA if their partner has an income regardless of the amount or is it means tested. Many thanks

    Contribution based ESA is not means tested so any income or savings from either the claimant or partner does not affect it. The only income that affects it is a personal pension of the claimant.

    It is awarded if the claimant has the correct class and amount of NI contributions during the last 2 tax years.

    It lasts for 365 days if placed in the Work Related Activity Group (WRAG) but is unlimited if placed in the Support Group.

    Pension Income of the claimant will have an £85 disregard before it affects it.
    AFAIK other incomes of the claimant could also affect it for example wages.
    Not sure about rental (landlord) income of the claimant - that has always confused me why JSA C (and presumably ESA C) does not ask the claimant if they own other properties and or receive rental incomes.

    Partners income will not affect it.
