7 day cooling off on mobile

Hi i purchased phone and o2 contract from go mobile on wed. Its now sat. I have only been using phone for 2 days. And last night it turned off and won't turn back on. I have decided that this isnt the phone for me as its broken already. Rather than exchanging for another phone.i would rather shop around before i decide what phone i want.and want to cancel the contract.
Have i got rights to cancel compltely as the phone is faulty. And its not been 7 days .

    With Vodafone they told me as long as i dont put the SIM card in the phone i get 7 days to cancel.

    Did you buy online or from a shop?

  • I brought from shop. But the phone is actually faulty. Surely i have rights over it being faulty.i don't want to be stuck with a phone that Will keep doing the same thing. I use my phone for everything. And it has left me not able to contact or do anything.

    Yep you will get another phone or the phone will be repaired. Probably just an update or reset the firmware.

    Quick look and their terms state to be returned in an unused state.

    If the handset is faulty within 28 days they will replace it.

    I dont think you get 7 days when buying in store, Website says you need to call them if returning within 7 days.
    So i doubt their terms are great either way.

  • As it was only a few days from purchase to the fault occuring, you have the legal right to reject it and ask for a full refund. (the SOGA states that you must be given a reasonable time to examine goods to ensure that they conform to contract and if they don't, then the contract can be cancelled).
    If you state this in the shop then you may well be refunded for the phone.

    The mobile contract is a different matter.
    As this has already started, you may not be entitled to cancel it, but if you can get a different model of phone and keep the contract going, this should hopefully solve your dilemma.
