    I don't agree, it there were 85 nappies in the pack, then the shop didn't lose out because they bought them wholesale thinking there were 80 also. In that case its the manufacturer who made the mistake, which is between them and the shop.

    With regard to going back to the shop and telling them that they undercharged me, then no it isn't a one way street I agree. In the same way that the supermarket makes a mistake in stocking their shelves near the special offers - (sic) and then expect us to notice and go and ask for our money back, I expect them to come and ask me for the difference if they have made a mistake and charged me too little. If I ever had a call from Tesco saying "We noticed that we undercharged you and would like you to give us the difference" then I would happily give them the difference if they were willing to come to my home and collect it in the same way that they expect me to go back to the store for overcharging on their part.

    I would of course expect to be permitted, at the shops expense, to go to the store and examine the shelf label in order to make sure that they are indeed telling the truth with regard to the error. Then I would give them a lecture on the importance of making sure that they carefully check their systems before charging me for the item I present at the till.

    Not a one way street, but many think it is.

    It’s difficult to know where the lines are drawn with this sort of thing.

    I do know that internal advertising which is actually false is a serious matter. Several years back I was temping at a major supermarket HQ when they were changing the software, and errors were frequent because no one understood the new system.

    We were repeatedly warned that if officials (trading standards…?) found that eg baked bean tins were only 5p off at the till when advertised as 10p off at the shelf, the fine could be quite a thumping one even it was just one store. Big enough that the company overall couldn't ignore it.

    How this plays into merely ‘misleading’ advertising I don’t know. I'd have thought that putting up a whole shelfful of stuff emblazoned with the wrong label would be pretty dodgy, but that's not an informed legal view.

    Maybe something comparable to the 'moron in a hurry' test applies? (That is a recognised legal phrase. :cool:)

    Incidentally, It is quite easy to get internal advertising wrong in stupid ways. A few years ago I saw it in a store myself: a shelf of mini-puddings proudly labelled as being “0p off”. I’m not kidding.

    I suppose everyone’s seen this (can’t post the direct link myself)?
