Final question so I have all info to pass on and can bid you good people goodnight.
Would either IS or an income ESA entitle them to tax credits for the children?Tomorrow is the most important thing in life0 -
Either would make no difference to tax credits as far as I am aware.
The one thing that concerns me is that if he claimed IS recently (and assuming she never actually closed her ESA claim and assuming she did complete an ESA3 at some point) maybe the act of claiming IS has automatically closed the ESA claim.... but I think you would have a good argument to say it should only have closed the ESA IR side of her claim not her ESA C (national Insurance credits) side of her ESA claim.
A quick phonecall will soon show that the ESA is open on a nil (£0.00) amount or closed and when and why it was closed.0 -
