    Well I have finally got a response from VCS. its quite a long winded response but essentially they are rejecting my appeal and say I can appeal to POPLA and they have attached a POPLA form.

    Can anyone tell me how I can post the letter I received into this forum (once I've scanned it).

    You can't post links as a newbie and we don't really need to see it. The important thing is that you are now at POPLA stage and simply need to read a few other threads to find out what wins at POPLA. Start with the 'POPLA decisions' thread at the top of the forum but read the recent cases at the END. Also read other threads where people have asked us to look over their POPLA appeal, as they will show what a winning POPLA letter looks like and will have links & advice already given.

    Also search the parking forum for 'Bylaws' or 'Airport' as a single keyword each time (and change the default to 'show posts' which gives a better search outcome) to read specific Airport cases which have the extra paragraph in any POPLA appeal, about bylaws = no registered keeper liability.

    Show us your draft POPLA appeal for fine tuning once you have copied & learned from other examples on this forum (about any PPC). Have you been careful never to infer who was driving? Keep it that way if so.

  • Hi everyone

    I've seen the threads about parking charges but I wonder if the advice can be used for a charge and fine for stopping.

    I collected someone from the airport on Sunday the 1st December. It was the first time I had driven to the airport for some time (it will also be the last). The road and passenger collection arrangements had changed since my previous visit. My passengers flight had arrived early and he was on his way out of the terminal building as I turned into the airport. He rang my car phone and said he was approaching the roundabout. I stopped to collect him -- his luggage was a small rucksack. He got in we set off. Result -- photograph and Parking Charge Notice from VCS for "Stopping and Waiting in Restricted Areas or Roadways". Fine £60 if paid within 14 days otherwise £100. I refuted the charge. I received a reply about my right to appeal to POPLA and saying 'pay now' or the fine increases to £100 and failure to comply may result in court proceedings whereby further costs will be incurred.

    So I am at the stage of composing my reply. Basically saying it is impossible to take in all the notices when driving into such a restricted airport, that the fine is unreasonable for the time stopped, and whatever other tips you can help me with.

    the first tip is that you should start your own topic by using the blue NEW THREAD button on the main forum, top left or bottom left, not hijack somebody else`s thread where circumstances may be different or different advice may be given

    it also shows respect to the thread owner who opened this thread/topic, and you would not like your own topic to be hijacked - would you ?

    I received a reply about my right to appeal to POPLA and saying 'pay now' or the fine increases to £100 and failure to comply may result in court proceedings whereby further costs will be incurred.

    So I am at the stage of composing my reply. Basically saying it is impossible to take in all the notices when driving into such a restricted airport, that the fine is unreasonable for the time stopped, and whatever other tips you can help me with.

    The quick tip is 'this charge is not a genuine pre-estimate of any loss' will win it at POPLA. Not ' the charge (it's NOT A FINE!!) is unreasonable' not 'disproportionate', the exact words about LOSS are needed, plus a few other things like them not owning the land/having no authority/byelaws taking precedence instead. We have loads of examples from Airports where a winning POPLA appeal is posted for you to copy.

    The other tip is to see my signature (not the red bit but the other writing below my post here). Shows you where to click to find page one and the current threads, and the ''Have you got a private parking ticket? Newbies please read this first'' sticky thread near the top (and the blue 'New thread' button if you still need it after reading the Newbies thread and if you want us to check your POPLA appeal draft, which we are happy to do in a new thread).

    'How to win at POPLA' is a link in the 'Newbies' sticky thread and will help you win it. Use a linked 'Airport example' of a POPLA appeal, read the tips about what to include, and draft your own version. I expect you have already 'outed yourself' as the driver which was a MAJOR MISTAKE but not insurmountable.

    We win 100% of POPLA appeals (and you'd lose if you only tell POPLA 'what happened' because mitigating circumstances are not considered at all in a POPLA appeal) so it's well worth you finding your way around the current forum and getting off this random thread.
