being off work sick when pregnant

My partner is currently 15 weeks pregnant. She started a new job in April with a small private company and completed her 3 month probation period in July.

Since becoming pregnant she has had approx 4 days off work due to morning sickness. She has today received an e-mail from her boss advising her that any further pregnancy related sickness will be paid as statutory sick pay.

Is her boss legally allowed to do this? I thought she would be entitled to fully paid sick leave?

Any advice would be great, thanks.

  • I beleive its only legal if she is off sick in the last 4 weeks of pregnancy

    Your partner is entitled to the same sick leave pay that the other employers get except that it should be noted as sickness during pregnancy in case of future problems with disciplinary action etc.

    So your partner needs to look at her contract and see what it says about sick pay. Some companies pay over and above SSP for a certain period of time, others only pay SSP after so many periods of sickness etc etc. it should be written in the contract

    If your Partner is treated any differently from any other employer as regards sick leave then she may have a case of discrimination.
