IVA ended June 2012

Hi all,

As anyone who has read my past posts knows, my final (60th) IVA payment was in June 2012, and I finally received my completion certificate in July 2013. :beer:

However, one of my debts was an HSBC loan, and another was a Nationwide credit card (amongst others).

When I checked my file, both were still outstanding and in 'default' on my credit file with Equifax, and with Noddle, although Experian shows clear.

I queried it with Noddle, whom I was able to contact more easily, and they said to send a copy of my certificate to the two institutions to close the account and clear the file.

Nationwide did this almost immediately - the card has disappeared from my internet banking screen and I was told by Nationwide it would likely disappear from the credit reference agencies one month later (it has).

However, HSBC have not responded to my letters, when I call they say someone will have to call me back but no one ever does. The loan disappeared from my internet banking when the IVA commenced (unlike Nationwide) so I can't see if they have done anything, but the balance still shows as default on my credit files.

Can anyone advise how to finally get rid of this, please?

    What was the start date of your IVA, and what is listed as the "default date" on the files for the HSBC debt?

    Until the entry drops off 6 years after the start date or your IVA, if the default date is correct, it should still show as a default. Just now your IVA is finished, that would be a satisfied/settled default.

    HSBC are a real pain to get an answer/response from, and will drag their feet if they can. Myself I found the only way to get action from them was to just make a complete nuisance of myself, sending the clean up request and a stern reminder, and backing that up with copies and formal complaints to as many customer service/data protection related email addresses as I could find.

    One option that might also get them moving is getting the FOS to write on your behalf.

    If the FOS will do that for you now, and they often will, then HSBC will find it a lot more uncomfortable to ignore them.

  • The start date was May 2007. I'd need to check the report (at home) to double-check the default date but presumably they are the same?

    If the default date is correct i.e. May 2007 then it should have dropped off a few months ago, by my reckoning.

    I didn't realise I could refer to the Ombudsman - but I will do, thank you.

    If the default date was May 2007, then yes, it should have dropped off. If it hasn't then that would be Equifax's error, not anyone else's as they are responsible for making sure they only display default records until they are 6 years old.

    Would not surprise me as Equiafx are hopeless at removing them. Experian and callcredit for all their failing do have half decent systems that automaticall take them off after 6 years. Equifax is pathetically hit and miss. The will sometime even lie and say it;s up to the creditor to remove them, which is just complete ballhooks.

  • Hi all, sorry for resurrecting an old thread but I still can't get this sorted!

    Quick summary - IVA started May 2007, last payment June 2012, completion certificate received July 2013.

    All defaults have disappeared except HSBC, who have randomly changed the default date to Sept 2008, which means it's still on my credit file (albeit showing as satisfied, now).

    How on earth can I make HSBC change it, please? I've written several times, threatened FoS and office of information commissioner and getting nowhere...... :mad:

    If anyone can give me any advice I'd be really grateful.

    Also have a word with the FOS to see if they will write to them.

    Also if it's gone 8 weeks since your initial complaint, you can take it to the FOS now.
