Mobile Phone not fit for purpose!

Guys need some advice on this please.......

Took out contract for my wife on Samsung Ace phone back in march 2012 with Orange for 24 months. Great little smart phone, but after a while things began to play up, mainly with message "cant update lack of memory"
Everything we put on was on memory card. Spoke to shop where we bought it, they returned it for repair, well reset to factory settings, nothing wrong with phone. Was working OK for a while then as preloaded apps updated, it was back to same issues:
WiFi cant be turned on unless turn phone off then on again.
Calls don't always ring, continually hangs, slow navigating.
Memory for this phone is about 384 meg with 100 meg + used on OS
Spoke with Orange again, said they could do nothing as it was phone with small memory, of course they said could do early upgrade @ £200 or claim on insurance if found to be faulty losing excess £50. The phones only worth £23!!
Surely they should not sell a Smart phone with preloaded apps that cant be updated due to lack of memory.
