Cleaning Up Credit Report

Hi,
I'm new to the forum so apologies if I'm posting in the wrong place! I'm really hoping that I can get some advice and support in helping to clean up my credit report and rebuild my credit rating.

I've recently obtained a copy of my credit report from Equifax which shows an old debt to Marlin Financial Services Limited who I understand bought a load of debts from Egg/Barclaycard. The default date is showing as 17/06/2008, although I believe that I haven't had any dealings with them since before then, possibly even as far back as 2005/2006. Would it be advisable to keep quiet about this debt until June 2014, when I am of the understanding that it will be unenforceable, then contact them to have this removed from my file? Due to changing addresses, I have not been contacted by anyone in relation to this debt and am not currently in a situation whereby I can repay them.

    The default will be removed from your file automatically in June 2014 no matter what you do. You don't need to contact anyone to make that happen.

  • Fab, so in the meantime can I just hope that they won't find me and ask for me to repay the debt?

    That is up to you. If you can't repay anyway, then......

    I assume you mean that it would be statute barred? The 6 years for that does not always coincide with when a default was added to your credit file. If I was you I would give National Debtline a ring on freephone 0808 808 400 to see when they think the 6 years for being time barred expires.

  • Thanks Fermi, yes I am referring to the debt being statute barred. Unfortunately I don't have any paperwork relating to this old debt and nothing is shown on my credit file other than the default, so would they still be able to help out? I don't want to open a can of worms by contacting Marlin to obtain copies of the paperwork.

    Hello iv got the same sorta thing as you , about default dates and SB ,

    Advisers told me to do a SAR on the original creditor, which will provide you with old account details e,g when your last payment was made , when and if a default notice was issued and any charged on your account from missed payments or late charges etc.

    The SAR does not knowledge the debt, its your right to obtain this information from the original creditor.

    When you get the SAR , find out the last payment date , this is the date 6 years on that the debt is now SB , and then find out the default date from the SAR and then 6 years from the default date the oringial crediter gave you , is the official one ,and its 6 years from that date you can get it removed ,

    If the date is different between default dates of the original and DCA wait till its SB and then contact CRA , and get them to remove default if they dont do it contact FOS

    Interestingly, I actually received a letter from Marlin on Saturday asking me to contact them to arrange a payment plan for the outstanding debt. Unfortunately there is no information on my credit report to suggest when the last payment was made to them however I am 75% certain it would have been more than six years ago. By obtaining the SAR, were you able to have it successfully removed from your credit file due to it being SB?

  • Just another further comment on this, they have also posted three default notices on my credit file, is this legal? Sorry for all the questions!
  • they can only default u once for one debt but can default u number of times for different debts , i did a SAR to find out the original default date and when last payment was made , the sneaky DCA put the default date one year later then the original default so i sent letter to CRA to get them to put the date to the original default date, this is what you should do if u believe the default date is wrong
