I have never stated that my statement is correct because i have mentioned ' based on my experience ' by giving an example of my friend in HSBC.

Whether it be in your experience or not, the fact remains that they CAN do it, they WILL do it and they HAVE done it because they are ALLOWED to do it.
They DO have authorisation and they DO NOT have to apply to a court to do it !!!!! :rolleyes:0 -
They are not allowed to do that. It wouldn’t be setting off. To set off, the account from where the money is taken has to be in credit and remain in credit. Using an overdraft would be shuffling debt around.YorkshireBoy wrote: »

Then that is your fact, BUT my fact is my friend only start paying it when the court letter has arrive to our house that they will start taking the money from his bank account if he still dont clear his debt.

Thanks for all of your help. I have passed the info onto my parents. Although it makes no odds to them as the payment would have been made using online banking anyway, it's just not very professional not to let them know that they planned on doing it or that they had done it!!

All banks can do it, but it's unusual for them to do it on only one missed payment, or even two. It's far more usual for them do it when the card is close to default.It's a health benefit ...0

If notice was to be given when a payment was going to be taken what would you do??
Most would empty the account first. That is why no notice was given.0
