Defaults I believe are wrong dates.

Hello
I`m trying to find out how i can find out the original default date from the original creditor.
I have moved home a number of times over the past 4-5 years.
I dont have any of the current accounts which i was paying the debt from, I also dont have any paper work of any sort to do with any credit agreement or default letters or payment reminders.
I need to be careful how i found out when the last payment was and the defaults was issued , so i dont start the count down again on the debt,
Also some of the DCA dont also have the original creditor on there letters , so what can i do about this ones?
I hope some of your wise folk can help me out on this one and im trying to get my credit in check.

If you are waiting in the hope that the debts will become statute barred then it is very difficult to find out any of the things you want to know.
It will near impossible to challenge the date a default has been entered without acknowledging you owe the money.
If DCAs don't list the creditors then you could send the prove it letter. This letter specifically does not acknowledge the debt so won't count as acknowledgement in relation to the limitation act, but could trigger more agressive debt collection acticity, more letters, possibly taking court action against you etc.
Prove it letter here - Letter when you know nothing about about the debt - AKA "Prove it" letterA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
With no information, there is nothing you can usefully do to make things 'better'. If the original creditor is not seeking repayment (by selling off the debt) your moral obligation to pay is extinguished.
Since the defaults will time out regardless of your subsequent actions, I'd jus ride out the time until your file self-cleans itself in due course.0 -

I believe my accounts would of defaulted around the 03/08 till 05/08
The defaults on the accounts from the DCA are saying 06/09 and 03/10 which is miles off when i do think i would of been given a default notice.
Also am i able to sent a SAR to the original creditor if its listed on the letter to find out when my last payment was made and when the original default was made , without the DCA knowing about it ?0 -
They may well inform the DCA of any letter you send to them or any response they send to you.
It looks too early to be trying to sort out your credit file (aside from making repayments towards the debts)
If you are hoping to sit out the time until the debts are definitely statute barred then it may be better to wait until you know for certain they are statute barred before making any complaints about the default dates that are registered on your credit file.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
ok thanks for your replies on the matter, i think i will try the SAR to the original creditor just to know where i stand on my old accounts , and then wait it out as i wont have to long now maybe 21 months at the most,0

I would like to think an SAR doesn't acknowledge the debt. Especially if you don't put account numbers on it. But not sure...:beer:0

I just spoke to a debt adviser and they said the SAR is just a standard letter to find out all my details of my old account as im allowed this information by law.
They said does not acknowledge any debt as its just a letter for account statements , charges on my account , last payment made , and if any default notice was issued on my account on which date.
